Ethical Dilemmas in Counseling

The final exam consists of four comprehensive essay questions. In preparing for these, students should be familiar with all relevant ethical codes and standards in addition to the weekly readings. Some ethical dilemmas are presented and students are required both to present the rationale behind their decisions and to delineate the issues they considered in coming to a decision.

Note that the focus of these responses shall be on synthesizing and applying knowledge already acquired over the course, not new research. Ensure, however, that all references and citations are accurate and complete, and as with the style of these essays, conform to APA standards.

Instructions: Please note that the following essay questions are NOT weighted equally. Be sure to consider the number of points allotted to each question and to respond accordingly in the length of your response. Please respond to each of the questions presented. (For example, there are several questions embedded within the first essay, and a complete answer must address each of those questions.)

1. (30 points) Assume that you intend to practice in a private practice setting in Canada. Please provide a clear and exhaustive list of the limits of confidentiality (in simple language that could easily be understood by a client irrespective of level of education). Please also discuss the ethics and laws related to record keeping. Finally, discuss the extent to which the treatment of children can be kept confidential from their parents and at what age they are deemed capable of consenting to treatment. (See the CCA Code of Ethics and Standards of Practice.)

2. (15 points) There are a number of distinct issues that emerge when working with individuals whose racial and/or cultural background is different from one’s own. Define “multicultural competence”. Describe the sort of multicultural training that the literature suggests best promotes the ethical treatment of diverse populations.

3. (30 points) Consider the limits of confidentiality that you delineated in Question I. Had those limits been discussed and an informed consent signed at the onset of treatment, please discuss how you would respond to your client disclosing his intention to have unprotected sex, despite positive HIV status, with an identified other. A complete answer should make reference to cases in the past that have set precedence with respect to a clinician’s duty to warn. A complete response should also indicate what conflicting ethical considerations were weighted in coming to your conclusion.
